    Our Terms & Conditions


     

    In the following you can find our terms and conditions for language courses (1.), trips (2.), youth camps (3.), and cultural program (4.)

     

    Please note that the German Terms and Conditions are the legally valid version, and this English translation is provided for informational purposes only. In any dispute about the meaning, wording, or interpretation of the Terms and Conditions, the German meaning, wording, or interpretation shall prevail.

     

     

    1. Language courses

    1.1. Registration

    You can register by telephone, fax, in writing, or online. Registration is binding even though the fee is not booked or transferred until the start of the course. Upon registration, participants enter into an agreement with the German-American Institute Tübingen (d.a.i.). The general terms and conditions are part of this agreement. Typically, no further confirmation is sent after registration. Participants only receive notice if there is a change in the course or program.

     

    1.2. Course fees

    Prices can be found in the current (German) language course brochure or on our homepage
    The German-American Institute Tübingen’s language course brochure usually shows two prices, a discounted price for d.a.i. members and a somewhat higher price for non-members. The course fee does not include costs for books or materials (if there is no note of this made in the course description). The course fee can be paid by direct debit procedure. The fee is usually debited in the third week after the start of the course. If a course is not suitable (because it is too difficult or too easy) for the participant, then it is generally possible to switch to another course if that course is not full. This change could mean that part of the fee is reimbursed or that an additional fee must be paid.

     

    1.3. Withdrawing and changing courses

    If a participant withdraws at the latest one week before the start of the course, the d.a.i. charges 10€, and in the week before the start of the course 15€ as an administrative fee. If the participant withdraws after the first time the course meets, 10€ and a proportional fee is charged. It is not possible to withdraw after the first week. For intensive, school, or compact courses (weekends), the participant can withdraw until one week before the start of the course. It is not possible to withdraw from TOEFL and TOEIC tests. The participant can withdraw in writing or in person in the office.

     

    1.4. Withdrawal or termination by the d.a.i.

    If the minimum number of participants (typically 6 participants) has not been reached by the start of the course or for other objective, justifiable reasons, the d.a.i. retains the right to shorten or cancel the course or to end it prematurely. The fees already paid will be reimbursed proportionately. Any additional claims by the participants are expressly excluded. 

    Not attending the course is not withdrawing!

     

    1.5. The following applies to all courses:

    There are no courses on legal holidays. The minimum number of participants for a language course is 6 people, the maximum number is 13 people. Exceptions are possible for certain courses. If the minimum number of participants (usually 6 participants) has not been reached at the start of the course or if there is another objective, justifiable reason, the d.a.i. retains the right to cancel the course or end it prematurely. Any fees that have already been paid will be reimbursed proportionately. In this case there is also the possibility to continue the course with a smaller number of participants and an additional fee or for a shorter duration. This will be discussed with those interested. The d.a.i. reserves the right to combine courses if courses have a too few participants and the level of knowledge is approximately the same. For language courses, the d.a.i. only hires instructors whose native language is English or Spanish (depending on the language of the course). Any additional claims by the participants are expressly excluded.

     

    1.6. Liability

    The d.a.i. is not liable for the loss of personal property during events in or outside of the Institute or for accidents in courses or on the way to and from the course rooms. If an event is cancelled or must be ended prematurely, or in the case of force majeure, the d.a.i. is not obligated to provide any services. The German-American Institute reserves the right to make necessary changes to the information provided in the program, especially the use of substitutes. The d.a.i. is not liable for errors, changes in fees, or printing errors.

     

    1.7. Certificate of participation

    After completing a course, the participants can receive a certificate of participation upon request. 

     

    1.8. Data protection

    Collecting, saving, and processing personal data is done on a voluntary basis. The data is used only for internal purposes. Data is protected according to legal provisions (Federal Data Protection Act, Bundesdatenschutzgesetz, BDSG).

     

    1.9. Provisions on private lessons

    Registration for private lessons can be done by telephone, fax, or in writing. Registration is binding even if the course fee is not booked or transferred until lessons start. With the registration form, the participant can have the fee paid with direct debit. The minimum booking is 10 lesson units. A lesson unit is 45 minutes. Additional courses made up of 10 lesson units can be subsequently booked. When doing so, it must be ensured that before starting each of the next 10 units, a new registration form is completed and turned in or faxed to the d.a.i. (fax: 07071-7952626). 10 units must be completed within 3 months from the time the registration form is turned in. If they are not, then the units that have not been completed expire. Participants are required to cancel lessons with advance warning. Typically, this means at least 24 hours in advance. In the first meeting, the participant and instructor will agree on the deadline for cancelling lessons as well as the mode of communication (cell phone, answering machine, fax, telephone). In 10 lesson units, it is only possible to cancel twice. If more units are cancelled, the participant will be charged for the additional lesson units missed, and the instructor is not obligated to find a new date to make them up.

     

     

    2. Trips

    2.1. Agreement

    Registration is done in writing – via mail or fax – with the German-American Institute Tübingen’s registration form or online with the registration form provided.
    The agreement takes effect when the d.a.i. receives your completed, signed registration form or when you click the button “Binding Registration” (“Verbindlich buchen”) and make the required deposit. This deposit causes the agreement to take effect.
    After the receipt of the deposit, the d.a.i. sends the person who registered confirmation and an invoice for the remaining amount. A refund security certificate is also issued and sent.

     

    2.2. Payment

    When registering, a deposit in the amount listed in the trip description is to be paid to the d.a.i. account (KSK Tübingen, BLZ 641 500 20, account number 109 042). After the deposit has been received, the d.a.i. sends the participant confirmation of the payment and an invoice for the remaining amount. The date by which the remaining amount is due is listed on the invoice and must be paid by that date.

     

    2.3. Services

    The services are listed in the description of services for the respective trip in the brochure.

    According to the German Tour Operator Act (Reiseveranstaltergesetz), the German-American Institute Tübingen is liable within the limitations of due diligence for conscientiously planning the trip, carefully selecting and monitoring the service providers, correctly describing all services named in this brochure, and properly providing the contractually agreed travel services.

     

    2.4. Prices and changes in the program

    All trips are carefully calculated upon publication of the brochure. The German-American Institute Tübingen reserves the right to increase the trip price if the following elements of the price change after the agreement has gone into effect and if they were unpredictable for the German-American Institute due to unforeseeable circumstances that increased these costs or created them, e.g. exchange rates for the respective trip, travel costs (in particular due to increases in cost of flights), taxes for certain services, airport fees, or security fees related to travelling. If prices must be increased, participants will be notified as soon as possible.

     

    2.5. Cancellation by the customer

    The cancellation fee is at least the amount of the deposit. Depending on when the participant cancels, the cancellation fee can be up to 100% of the price of the trip. Until 30 days before the start of the trip, the cancellation fee is at least 50%, with the absolute minimum being the reimbursement of all costs incurred. Until 15 days before the start of the trip, 80% of the price is retained as a cancellation fee, and after that no refund is possible (100% of the cost of the trip).

     

    2.6. Cancellation by the German-American Institute Tübingen

    The tour organizer retains the right to cancel trips if there are not enough participants. 

     

     

    3. Youth camps and youth trips

    3.1. Prices and changes to the program

    All trips and camps are carefully calculated at the time of publication. The German-American Institute Tübingen reserves the right to increase the trip price if the following elements of the price change after the agreement has gone into effect and if they were unpredictable for the German-American Institute due to unforeseeable circumstances that increased these costs or created them, e.g. travel costs or taxes for certain services. If prices must be increased, the participants will be informed as soon as possible.

     

    3.2. Event organizer and liability

    According to the German Tour Organizer Act, the German-American Institute Tübingen is liable within the limitations of due diligence for:

    Conscientiously planning the trip
    Carefully selecting and monitoring the service providers
    Correctly describing all services listed in this brochure
    Properly providing the contractually agreed travel services.

    The organizer reserves the right to cancel trips and camps if there are not enough participants.

     

    3.3. Cancellation terms for youth camps

    Up to one month before the start of travel: 20% of the camp cost.
    From 1 month to 1 week before the start of travel: 20-80% of the camp cost.
    Cancellation in the week before the start of travel: 100% of the camp cost.
    We reserve the right to cancel or shorten camps that do not reach the minimum number of participants.
    Cancellation is only possible in writing or in person in the d.a.i. office.
    For each additional sibling registered for one of our camps, you receive 25% off the price of the cheaper camp.
    It is possible for those who have the KreisBonusCard to receive a 50% discount on the Musical Theater, Kids’, U.S. Sports, and Nature Camp! Please note: The number of spots available for the discounted prices is very limited! The sibling discount cannot be applied to registrations done with the KreisBonusCard.

     

    3.4. Cancellation terms for youth trips

    The cancellation fee is at least the amount of the deposit. Depending on when the participant cancels, the cancellation fee can be up to 100% of the price of the trip. Cancellation fee insurance with a deductible (20%) is included in the price of the trip. Please find additional information and our General Terms and Conditions on the d.a.i. website.

     

     

    4. Cultural program

    4.1. Contracting partner

    The contracting partner is the German-American Institute Tübingen (d.a.i.), Karlstr. 3, 72072 Tübingen.

     

    4.2. Registration

    Depending on the event, registration is done either in person, by telephone, or by e-mail to the office or using the online form on the d.a.i. Tübingen’s homepage (www.dai-tuebingen.de). Registration is binding. Your registration must have been received by the d.a.i. Tübingen by the deadline given for the event.

    If it is possible for you to participate, the d.a.i. Tübingen will send confirmation of registration including the invoice amount. With your registration, you authorize us, the German-American Institute Tübingen, to pull direct debit payments from your account using the SEPA direct debit procedure. At the same time, you instruct your banking institution to process SEPA requests from our Institute to your account.

    Because the number of participants is limited from some events, registrations are considered in the order in which they are received.

     

    4.3. Cancellation by participant

    If you are not able to participate in an event for which you have registered, you can ask someone to go in your place. If you cannot find anyone to take your place, then you cancel your participation, meaning that you pay 50% of the event fee. For short-notice cancellations (7 days before the start of the event), you are required to pay 75% of the event fee. If you cancel after the registration deadline, do not participate in the event without informing us that you are cancelling, or if you leave the event early, then you remain obligated to pay 100% of the price.

    Cancellations or notifications that you have found someone to take your place are to be sent to us in writing by mail, fax, or e-mail. The date upon which the d.a.i. receives the cancellation is decisive for determining the number of days before the start of the event.

     

    4.4. Cancellation by event organizer

    If the service we owe cannot be provided due to unforeseeable circumstances for which we are not at fault (e.g. if the minimum number of participants is not reached or if the speaker becomes ill at short notice), we reserve the right to cancel the agreement in whole or in part or, if we choose, to postpone the service for the duration of the hindrance. In these cases, participants will be notified as soon as possible. The participants will be reimbursed any fees they have paid for the cancelled event; any additional claims are excluded.

     

    4.5. Data protection

    Personal data that you send to the d.a.i. for registering for and carrying out events will be saved, processed, and used by the d.a.i. Tübingen according to legal data protection provisions. The data will only be used for this purpose and saved in electronic form. If third parties must be included, we will ensure they are aware of their obligation to maintain confidentiality. By registering, you consent to the processing of your data. You may revoke this consent at any time in writing or via e-mail to the d.a.i. effective for the future.

     

    4.6. Any additional agreements must be made in writing to be valid
